    The relief for EB3 comes because a lot of EB2's/EB1's will be gone from the quota. So, if the queue is smaller, you get it faster. The way I look at it, we want the queue to be smaller.

    But let me remind you that this seems to be the same provision that S1932 had in the past. If passed as it is, gives some relief for so many people who are waiting to file I-485. but keep in mind that AC-21 should be brought back in, to take any advantage of portability

    My lawyer told my checks cashed today. My details
    EB2 -> PD Sept 2003
    I140-> Applied to NSC-> Approved by TSC->March 2007
    I485->Applied to NSC -> Delived to NSC on 26th June-> checks cashed on Aug 9th by TSC

    TSC is moving like a snail. Last week we saw just couple of cases getting receipt or checks chased for Jun 26 or less and even this week TSC has not moved a day.

    Is there anyone who got their checks cashed for the TSC case submitted to NSC on June 27th onwards?

    Sent on Jun 29th. I don't know when it has reached. My dates were available in June. I am hoping it should have reached Jun 30th.

    Anyone know if they accept packages on Saturday?

    I'm in very similar situation. My dates were available for June as well. My HR/Attorneys did this long and painful bureaucratic process. We have an internal website which says that my case was �filed� on Jun-29th. Don�t know what the fuck that means. Whether it was sent on 29th or received on 29th? Couldn�t get HR to answer.Don�t have direct communication lines with Attorneys... If it�s sent on 29th, does USCIS take packages on Saturday or Sunday? If they take only on Monday, will they throw it out because it reached in July? Oh well, just have to wait and see...

    We want to do some thing for elimination of backlogs Especially for EB3 - India Else we wont see any more progress.

    All EB3 people please share your thoughts to resolve this issue.
    Unless and untill everybody in EB3 has contributed ataleast a $1000.00 to the immigrationvoice cause, its waste of time to discuss about the EB3-India movement. Any way we have to spend a lot more than $1000.00 in renewing EADs, H1Bs and H4s.


    Otherwise just wait and pray for the CIR bill to pass. Then every body in the EB category will get the benefit being the EB3- India/China are the greatest benefitters.

    Here is what you do,

    1. Do not talk to them on phone
    2. Send them a letter stating keeping your salary is against law. If they think you owe them the money, send you a letter explaining why they think the money is owed and how much, state that filing of labor is a cost to the company and not to the employee as per DOL
    3. Give them a time limit of 30 days.
    4. Ask them to send all the correspondence to your home address.
    5. Send them a letter with some kind signature rcpt.

    Wait and see, If they have a real claim then they will respond to you otherwise they will send your money.

    Is it fair to have an EB2 person write - what "a" unfair system :eek:

    Yeah tell me about it! It is not enough that Eb3 gets screwed left right AND center. Now we have people applying pressures from the top and bottom as well, and to top it off, Eb2 people who:

    1) Get ALL the spill overs from Eb1 and
    2) Have fewer people drinking from their pool (As opposed to every tom dick & harry taking their share from the Eb3 pool, nurses to name a few).

    now complain that the system is unfair coz processing is not sequential. So everyone in the core team, please forget all about the people suffering in Eb3 and focuss SOLELY on the Eb2 people. Actually dont even focus on all EB2, just the fact that EB2 is not being processed sequentially.

    What a load of crock!!

    Guys everybody has a story, in my area Labors were getting cleared in less than 1 month in mid of 2003. When my attorney filed my labor and we didn�t hear on it for 3 months, my Attorney called up the local labor dept. they told him that the person who used to do foreign labor certs met with an accident and is on extended leave, It took 13 months for the local office, by that time BECs were born, retrogression�..

    Friends - I went for FP appointment on 10/23/2007. But when I check USCIS website. The LUD still shows me 09/20/2007 on I-485. Please let me know if this is normal...

    my EAD is still pending. but no lud on EAD cases. just a soft LUD on I-140 on 7/13. Very wired !!

    what is this analogy none sense..... u'r a disgrace to eb2...... date porting is codified in the law..... no one can change it but congress....... the problem with congress is that it cannot agree with anything related to immigration...... let's say they decide to do just one thing, just one....... do u truly believe that anybody other than u on this planet would care to stop porting of eligible applicants to eb2?...... pls keep me posted if you send out any communication to anyone for stopping porting.... becoz i'll send double the number of emails and letters to keep porting in place.....

    i do have a suggestion for u...... if everyone is porting from eb3 to eb2..... maybe u should stay ahead of the curve and port from eb2 to eb3...... then u will be the only applicants left in entire eb3..... :rolleyes:

    The answer to your question is: Nothing. They may be waiting, because of many reasons like, they are scared, do not care, there are other opportunities, tired of this immigration crap, lack of enough knowledge regarding their rights.

    Now, I do not think the onus correcting such mistakes is 100% on the EAD folks' shoulders. I remember reading how slavery ended in this country. Slavery died, not because the black people fought for the abolition of slavery; slavery ended when the white man realized that slavery is wrong.

    Based on the same logic, I would say that the job of stopping discrimination against EAD/H1B etc. is mainly the responsibility of Citizens and GC holders. It is their country; it is up to them to fix it.

    My question is -
    what are these "1000s of folks" doing? Are they waiting for someone else to work for their cause?

    If they believe they were wronged, they need to take action. Without any action, nothing is going to happen.

    And, yes, these is discrimination on the both side of the lines. Have you looked at the hiring practices of leading desi outsourcing/consulting companies in the US?
