She is great. I just spent 15 minutes talking with her. She has all her questions written in front of her and she seems really serious about pursuing this story.
Every one should call her at 2023346701, name is Xiyun
I spoke to this journalist for almost 20 minutes
She is awesome and really really listens to you and gets a lot of information to you
THIS IS A LIVE PERSON
She is interested in talking more people and also if possible with other ASIAN people (Chinese/Taiwanese/Pakistanis), who are in the same boat
Call her and she picks up the call.

If AC21 memo is non-binding, which immigartion law is binding? We can go with only current rules/laws; the rest is speculation.
USCIS memoranda articulate internal guidelines for agency personnel; they do not establish judicially enforceable standards.

H1B is a non immigrant visa, and they dont have the full constitutional rights, for eq they dont have the right to vote.
Legally we are not immigrants, that is the worst mistake( calling ourselves immigrants) ,being done by us,
If USCIS denies GC for security reasons, you cant sue them.
No onde denies that we cannot vote. But we have the basic rights, like being treated "equally and fairly". For example, if some employer violates labor law and did not pay you for your work, I am sure you can sue, even though you are not a citizen. There are some basic rights that everyone has, esp. if you hold good fainth and are damaged. Statement that you do not have any rights as you are not a citizen is just wrong. I am wondering how this will impact people's (esp. people from other countries) perception about this.

1. Good health (which we often take for granted)
Wish list - against stress
4. Good savings (all said and done, your bank balance is very important no matter where you stay in the world)
Sold house in India to meet expenses here.
5. Good work experience (this is transferable and more or less ensures a decent future)
At the same level, same job for years and years
6. Loving/caring family/friends (who will always love you the same and couldn't care less about GC or citizenship)
What is this in USA?
This is personal experience, people may have different view.

Good job. Thanks.:D
Average worldwide processing time for employment based green card applications is 1.43 years (Priority Date to GC approval).
In simple words, it takes 5.5 years to wrap up the 1 year GC demand for Indian applicants presuming there is no overflow from any other country GC visa quota.
http://spreadsheets.google.com/pub?key=pezNTiCXNupwoSrZGE4kqcg
Above conclusion is drawn after comparing the statistics for just the 2007 PERM data from DOL.
http://www.shusterman.com/pdf/perm07.pdf
I also assumed that there are 1000 Non-Perm cases for India alone, but changing it would not affect the results a lot.
Just imagine the demand that would have been in years 2000~2002 and thats a project for another er!
Unless we stand up unitedly, talk to the senators and raise our voice, we can plan on retiring on H1. It may be now or never!

In ideal situation Desi employer should provide value rather than just scrape money as revenue sharing mechanism.
If a desi employer can go and get projects and becomes preferred vendor, he would not even do H-1s. He will use a Sub. Believe me H-1B visa is a pain in the ass even for the employer too.
There is a reason desi employers exist. both the desi employers and desi employees pick the best possible scenario/solution with respect to their situation.

(d) Treatment of Family Members. - A spouse or child as defined in subparagraph (A), (B), (C), (D), or (E) of section 101(b)(1) shall, if not otherwise entitled to an immigrant status and the immediate issuance of a visa under subsection (a), (b), or (c), be entitled to the same status, and the same order of consideration provided in the respective subsection, if accompanying or following to join, the spouse or parent.
This basically tells me that they need to be given the same status only if they can't given immigrant visa in other category. But if they can be, why should they be used in this category? As someone said earlier, FB for Family is actually better than EB2. So this basically rules out their rational on giving EB2, EB3 dependents on this VISA.
I am not talking about EB1 here.
Naveen, I haven't given you any Reds. I feel sorry for your situation. Guys, lets discuss and analyze in a constructive way and don't go personal. None of us here will get GC twice by chasing someone's moral down..

Also you seems to be straying from the original intent of the thread...
mirage,
The original intent of the thread is flawed and against the very purpose of creating such a thread. We have explained you during the phone conversation that it is not the right time to pick up country limits issue. We have run this by our strategist again and they have also advised us that its not the right time for this issue. Others on the forum, including unitednations, have also made an attempt to explain you the issues we are all dealing with. You are free to do whatever you think is best for you. We think that your actions are likely to harm the community effort.
